    Digital Currency Regulation Established in Russia

    The circulation of digital currency in Russia is now governed by a separate legal regime: the Federal Law of the Russian Federation No. 282-FZ "On Digital Currencies and Digital Rights" was adopted on August 4, 2026. The document defines the status of digital currency, transaction rules, mining procedures, and restrictions on domestic payments.

    What is Considered Digital Currency

    Digital currency is described as property in the form of electronic data: a digital code or designation placed in an electronic system. This currency can be used as a means of payment or as an investment, but it is not recognized as an official monetary unit of Russia, a foreign state, or an international settlement unit.

    An important detail: this property does not have a liable person who would be responsible to each owner. However, digital currency has received civil legal status as property. For disputes, this is crucial: it can be classified as an object of rights, demanded for return in case of theft, and can also be subject to enforcement.

    For businesses and accounting, this means a clearer legal framework: digital currency can be considered an asset. Accounting has a basis to more accurately reflect such objects if they are related to the company's activities. In a broader financial context, alongside digital rights and securities, such objects come under the scrutiny of regulators, including the Bank of Russia as the Central Bank and the Ministry of Finance of the Russian Federation.

    Which Laws Regulate Digital Assets

    The basic act for this area remains Federal Law No. 259-FZ "On Digital Financial Assets, Digital Currency, and Amending Certain Legislative Acts of the Russian Federation." It establishes the rules for the issuance, accounting, and circulation of digital financial assets, as well as the general place of digital currency in Russian law.

    Digital Financial Assets (DFAs) and digital currency are regulated differently. DFAs are closer to digital rights: they are issued through information systems and are usually linked to a specific liable person. Digital currency, on the other hand, is described as property in the form of electronic data without a liable person to each owner.

    Several bodies are responsible for the market. The Bank of Russia regulates the financial infrastructure and operators related to DFAs. The Ministry of Finance of the Russian Federation participates in developing rules for digital currencies and tax policy. The Federal Tax Service of Russia controls the tax aspect, income declaration, and registers related to mining.

    Separately, there is the digital ruble. This is the digital form of the Russian ruble issued by the Bank of Russia. Legally, it remains a national currency, not a cryptocurrency or DFA. Its advantage is that payments are made in rubles through a single platform of the Bank of Russia, rather than through a private crypto asset or cash.

    Transactions to be Handled by Special Operators

    The law restricts the free circulation of digital currency: such operations can only be organized by special market participants.

    Such participants include:

    • Trading organizer.
    • Broker.
    • Trust manager.
    • Digital depository.
    • Exchange organization.
    • Clearing organizations.

    A common set of obligations is introduced for all listed participants:

    • Identify clients.
    • Protect clients' interests during transactions.
    • Prevent transactions and operations that may occur without the client's consent.
    • Reduce risks of operations related to money laundering.

    For legal entities, this means that transactions with digital currency will go through a more formalized infrastructure. Individuals must also consider new restrictions if they plan to buy, sell, or use cryptocurrency in legally permitted cases.

    Cross-border transactions are not becoming free for any operations. They are only permitted in cases explicitly allowed by law, primarily in foreign trade transactions. Exchange trading and cryptocurrency exchanges must also go through special participants, rather than bypassing the established infrastructure.

    Mining Allowed, but with Restrictions

    Mining can be conducted by:

    • Russian organizations.
    • Individual entrepreneurs.
    • Ordinary citizens.

    For individuals, registration in a special register of the Federal Tax Service of Russia is not mandatory if they do not exceed energy consumption limits. These limits are set by the Government of the Russian Federation.

    At the same time, bans are being introduced for certain categories of entrepreneurs. For example, mining cannot be conducted by individuals with unexpunged or outstanding criminal records for economic crimes or crimes against state authority.

    Where Cryptocurrency Can Be Used for Payments

    Using cryptocurrency as a means of payment is not allowed in all situations. The law permits such transactions in foreign trade deals, as well as for payments for services related to cryptocurrency mining and exchange.

    Additionally, cryptocurrency can be used to purchase other currencies, digital rights, and securities. In this context, a security remains a separate object, and cryptocurrency does not turn into regular money.

    Within the Russian Federation, paying with cryptocurrency for everyday goods, works, and services is prohibited. Thus, cryptocurrency acquires the legal status of property and a tool for specific operations but does not become a universal means of payment in the domestic market.

    For citizens and investors, the key restriction is that buying, selling, and using cryptocurrency can only occur in permitted cases and through the legally prescribed infrastructure. Storing cryptocurrency does not, by itself, make it a means of payment within the country. For non-qualified investors, there may be additional restrictions when dealing with digital assets if such rules are established for a specific instrument or platform.

    Taxes and Reporting

    Income from transactions with cryptocurrency and digital financial assets (DFAs) falls into the tax base. For individuals, this is usually personal income tax (PIT), and for organizations, it is corporate income tax. Expenses can be accounted for if they are documented and related to the corresponding operations.

    For DFAs, tax consequences depend on what the owner received: income from sales, payments under digital rights, or other economic results. Such operations need to be recorded as carefully as transactions with other financial assets.

    Individuals report income from transactions with cryptocurrency and DFAs using form 3-NDFL for the year in which the income was received. Organizations reflect such operations in their accounting and tax records and submit declarations in the usual manner. Failure to declare income may result in additional assessments, penalties, and fines under tax regulations.

    When the New Rules Will Take Effect

    The timelines are distributed as follows:

    • The main part of the law - September 1, 2026.
    • The rule that the circulation of cryptocurrency can only be organized by special entities - July 1, 2027.
    • The ban for residents on transactions with cryptocurrency bypassing entities that organize its circulation - July 1, 2027.
    • Requirements for measures against transactions without client consent - September 1, 2027.

    Further adjustments to the regulation will occur through amendments and subordinate regulations: these should clarify the operations of operators, transaction monitoring, tax accounting, and practical application of restrictions for market participants.

    The law was adopted by the State Duma and signed by President Vladimir Vladimirovich Putin, after which cryptocurrencies and digital rights received a separate place in the Russian regulation of financial assets.
