The elections on November 3 will define the pace of Bitcoin regulation in the U.S.
- Polymarket and Kalshi already discount a Democratic House with a 90% probability as of November 1.
- Bitcoin has less direct regulatory exposure than ETH, DeFi, stablecoins, and tokenization.
In the midterm elections taking place next Tuesday in the United States, not only will Congress be renewed, but it will also be determined whether the cryptocurrency sector moves towards a clear legal framework or remains trapped in an administrative uncertainty that has lasted for years.
Whoever wins, the result will set the pace for the oversight of exchanges, stablecoins, and tokenization over the next two years.
A total Democratic control could hinder comprehensive legislation and reinforce the power of agencies; a divided Congress would prolong the stagnation experienced in recent months; while a Republican retention would reopen the door to more favorable rules. In any scenario, Bitcoin is relatively less exposed than the rest of the ecosystem.
Prediction markets have already taken positions. As of November 1, Polymarket and Kalshi assigned Democrats more than a 90% probability of controlling the House and around 72% of taking the Senate. This means that a good part of the baseline scenario is already priced in. What could move the market is the surprise: if Republicans retain the Senate, if the Democratic wave turns out to be stronger than expected, or if leadership in key committees changes.
Several analysts agree that the impact will be uneven. Grayscale argues that the electoral outcome will matter "only at the margins" for Bitcoin, as institutional adoption, public debt, and demand for alternative assets can continue to drive the market regardless of who controls Congress.
Firms like Pepperstone and BIT.com propose similar scenarios. A Democratic sweep would increase legislative uncertainty and weigh more on cryptocurrencies like ether (ETH) and solana (SOL), as well as on DeFi platforms, stablecoins, and tokenization projects. All this, while Bitcoin ---already treated as a commodity--- would show less direct sensitivity.
The performance of cryptocurrencies and companies in the ecosystem could also be affected by the fate of projects like the CLARITY Act. This is the law that seeks to divide oversight between the Securities and Exchange Commission (SEC) and the Commodity Futures Trading Commission (CFTC) and require federal registration for exchanges.
In fact, the industry allocated more than $200 million to these elections precisely to unlock that framework, which has recently stalled in Congress (according to figures documented by Public Citizen and Reuters).
The main concern is that, while legislation remains stalled, regulators continue to advance through administrative means: the SEC has already granted a temporary exemption for the on-chain trading of tokenized stocks; while the CFTC has already published an Advanced Notice of Proposed Rulemaking. As reported by CriptoNoticias, with this mechanism, this Commission seeks to create its own federal framework for retail transactions of leveraged crypto assets, and a new type of exchange registration adapted to these products.
It is expected that on November 3, it will not only be decided whether there will be specific regulation for the cryptocurrency ecosystem, but also who will write it and at what speed over the next two years.
A divided or Democratic Congress could leave the ecosystem in the hands of the SEC and CFTC for longer. A broader Republican victory would reactivate expectations that the CLARITY Act will soon be approved. In any case, Bitcoin maintains a relatively more stable position, although the rest of the ecosystem ---exchanges, DeFi, stablecoins, and tokenization--- has much more to gain or lose.
In any case, analysts foresee a highly uncertain political scenario predicting that the election outcome could significantly alter the regulatory course. All this, despite the advances already made in the last year in legislative matters and the support granted to the sector by President Donald Trump.
